國務院辦公廳關于加快推進社會信用體系建設構建以信用為基礎的新型監管機制的指導意見

各省、自治區、直轄市人民政府,國務院各部委、各直屬機構:

      為加強社會(hui)信用(yong)體(ti)系建設,深入推進(jin)“放(fang)管(guan)服(fu)”改革,進(jin)一步發(fa)(fa)揮信用(yong)在創新監(jian)管(guan)機制(zhi)、提高監(jian)管(guan)能力和水平方面(mian)的基礎性作用(yong),更(geng)好激發(fa)(fa)市場主(zhu)體(ti)活力,推動高質量發(fa)(fa)展,經國務院(yuan)同意(yi),現提出(chu)如下(xia)意(yi)見。

       一、總(zong)體(ti)要求

       以習近平(ping)新時(shi)代中(zhong)國特色(se)社會(hui)主義思想為(wei)指導,深入貫徹(che)落(luo)實黨的十九大和(he)(he)十九屆二中(zhong)、三中(zhong)全會(hui)精神,按照依法依規、改革創新、協同共治的基本原則(ze),以加強(qiang)信用監(jian)管(guan)(guan)(guan)為(wei)著力點(dian),創新監(jian)管(guan)(guan)(guan)理念、監(jian)管(guan)(guan)(guan)制(zhi)度和(he)(he)監(jian)管(guan)(guan)(guan)方式,建立健全貫穿市場(chang)主體(ti)全生命周(zhou)期,銜接事(shi)前、事(shi)中(zhong)、事(shi)后全監(jian)管(guan)(guan)(guan)環節(jie)的新型監(jian)管(guan)(guan)(guan)機制(zhi),不斷提升監(jian)管(guan)(guan)(guan)能力和(he)(he)水平(ping),進一步規范市場(chang)秩序,優化(hua)營商環境,推動高質量發(fa)展(zhan)。

       二、創新(xin)事前環節信用監管

     (一(yi))建(jian)立健全信(xin)(xin)用(yong)(yong)(yong)承諾(nuo)(nuo)(nuo)(nuo)(nuo)制(zhi)度(du)。在辦理適用(yong)(yong)(yong)信(xin)(xin)用(yong)(yong)(yong)承諾(nuo)(nuo)(nuo)(nuo)(nuo)制(zhi)的行(xing)政(zheng)(zheng)許(xu)可(ke)事(shi)項(xiang)時(shi)(shi),申請(qing)人(ren)(ren)承諾(nuo)(nuo)(nuo)(nuo)(nuo)符合審批條件(jian)并提交有關(guan)材料的,應予即時(shi)(shi)辦理。申請(qing)人(ren)(ren)信(xin)(xin)用(yong)(yong)(yong)狀況較好、部分(fen)申報材料不齊備(bei)但書面承諾(nuo)(nuo)(nuo)(nuo)(nuo)在規(gui)(gui)定期限(xian)內(nei)提供(gong)的,應先(xian)行(xing)受理,加快辦理進度(du)。書面承諾(nuo)(nuo)(nuo)(nuo)(nuo)履約情況記入信(xin)(xin)用(yong)(yong)(yong)記錄(lu),作為事(shi)中、事(shi)后監管的重要(yao)依據,對不履約的申請(qing)人(ren)(ren),視(shi)情節(jie)實施懲戒。要(yao)加快梳理可(ke)開展信(xin)(xin)用(yong)(yong)(yong)承諾(nuo)(nuo)(nuo)(nuo)(nuo)的行(xing)政(zheng)(zheng)許(xu)可(ke)事(shi)項(xiang),制(zhi)定格(ge)式規(gui)(gui)范的信(xin)(xin)用(yong)(yong)(yong)承諾(nuo)(nuo)(nuo)(nuo)(nuo)書,并依托(tuo)各級信(xin)(xin)用(yong)(yong)(yong)門(men)戶網(wang)站向(xiang)社會(hui)(hui)公開。鼓勵(li)市場主體主動向(xiang)社會(hui)(hui)作出信(xin)(xin)用(yong)(yong)(yong)承諾(nuo)(nuo)(nuo)(nuo)(nuo)。支持行(xing)業(ye)協(xie)會(hui)(hui)商會(hui)(hui)建(jian)立健全行(xing)業(ye)內(nei)信(xin)(xin)用(yong)(yong)(yong)承諾(nuo)(nuo)(nuo)(nuo)(nuo)制(zhi)度(du),加強行(xing)業(ye)自律。(各地區各部門(men)按職責分(fen)別負責)

     (二)探索開(kai)展(zhan)經(jing)營者準(zhun)入前誠(cheng)信(xin)(xin)(xin)教育(yu)。充分利用各級各類政(zheng)務服務窗口,廣泛開(kai)展(zhan)市場(chang)主(zhu)體守法誠(cheng)信(xin)(xin)(xin)教育(yu)。為(wei)市場(chang)主(zhu)體辦理注冊、審(shen)批、備(bei)案等相關業務時,適時開(kai)展(zhan)標準(zhun)化、規范化、便捷化的法律知識(shi)和信(xin)(xin)(xin)用知識(shi)教育(yu),提高(gao)經(jing)營者依法誠(cheng)信(xin)(xin)(xin)經(jing)營意(yi)識(shi)。開(kai)展(zhan)誠(cheng)信(xin)(xin)(xin)教育(yu)不得收(shou)費(fei),也不得作為(wei)市場(chang)準(zhun)入的必要條件。(各地區各部門按職責分別負責)

     (三(san)(san))積極(ji)拓展信(xin)用(yong)報(bao)(bao)告應用(yong)。鼓勵各類市場主體(ti)在(zai)生(sheng)產經營活動(dong)中更廣泛、主動(dong)地(di)應用(yong)信(xin)用(yong)報(bao)(bao)告。在(zai)政(zheng)(zheng)府(fu)采購、招標(biao)投標(biao)、行(xing)政(zheng)(zheng)審批、市場準(zhun)入、資(zi)質審核等事項(xiang)中,充分發揮公共信(xin)用(yong)服務機構和第三(san)(san)方信(xin)用(yong)服務機構出具的(de)(de)信(xin)用(yong)報(bao)(bao)告作用(yong)。探索建立全國(guo)統一的(de)(de)信(xin)用(yong)報(bao)(bao)告標(biao)準(zhun),推(tui)動(dong)信(xin)用(yong)報(bao)(bao)告結果實現異(yi)地(di)互認(ren)。(發展改革委、人民銀行(xing)牽頭,各地(di)區各部門(men)按職責分別負責)

       三、加強(qiang)事(shi)中環節信用監管

      (四)全面建立市場(chang)(chang)主(zhu)體信用(yong)(yong)(yong)記(ji)錄(lu)。根據權責(ze)清單建立信用(yong)(yong)(yong)信息采集目錄(lu),在辦理注冊登記(ji)、資質審(shen)核(he)、日常監管、公共服務等(deng)過程中,及時(shi)、準確、全面記(ji)錄(lu)市場(chang)(chang)主(zhu)體信用(yong)(yong)(yong)行為(wei)(wei),特別(bie)是將失(shi)信記(ji)錄(lu)建檔留痕,做(zuo)到(dao)可(ke)查可(ke)核(he)可(ke)溯。(各地(di)區各部門按(an)職責(ze)分別(bie)負責(ze))完善法(fa)人和非法(fa)人組織統(tong)一社會(hui)信用(yong)(yong)(yong)代碼制度(du),以(yi)統(tong)一社會(hui)信用(yong)(yong)(yong)代碼為(wei)(wei)標識(shi),整合形成完整的(de)市場(chang)(chang)主(zhu)體信用(yong)(yong)(yong)記(ji)錄(lu),并通過“信用(yong)(yong)(yong)中國(guo)”網(wang)站、國(guo)家(jia)企業信用(yong)(yong)(yong)信息公示(shi)系(xi)統(tong)或中國(guo)政府網(wang)及相關部門門戶(hu)網(wang)站等(deng)渠道(dao)依法(fa)依規向社會(hui)公開(kai)。完成12315市場(chang)(chang)監管投訴(su)舉報熱線和信息化平臺(tai)整合工作,大力(li)開(kai)展消費(fei)投訴(su)公示(shi),促進經營者(zhe)落(luo)實(shi)消費(fei)維權主(zhu)體責(ze)任。(發展改革委、市場(chang)(chang)監管總局負責(ze))

     (五)建立(li)健全(quan)信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi)自(zi)(zi)愿注(zhu)冊(ce)機制。鼓勵市場(chang)主(zhu)體在“信(xin)(xin)用(yong)中國(guo)”網站(zhan)或其(qi)他渠道上自(zi)(zi)愿注(zhu)冊(ce)資質證(zheng)照、市場(chang)經(jing)營、合同履約、社會公(gong)益(yi)等信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi),并對(dui)信(xin)(xin)息(xi)(xi)真(zhen)實性公(gong)開作出信(xin)(xin)用(yong)承(cheng)諾,授權(quan)網站(zhan)對(dui)相關信(xin)(xin)息(xi)(xi)進行(xing)整合、共享與應用(yong)。經(jing)驗證(zheng)的自(zi)(zi)愿注(zhu)冊(ce)信(xin)(xin)息(xi)(xi)可作為開展信(xin)(xin)用(yong)評價和生成信(xin)(xin)用(yong)報(bao)告的重要依據。(發展改革委(wei)牽頭,各部門(men)按職責(ze)分別負責(ze))

     (六)深(shen)入開(kai)展(zhan)公共信(xin)(xin)用(yong)(yong)(yong)綜合(he)評(ping)(ping)價(jia)。全國信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息共享平臺要加強與相(xiang)關部(bu)門的協(xie)(xie)同配合(he),依(yi)法依(yi)規整合(he)各類信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息,對(dui)市場主(zhu)體開(kai)展(zhan)全覆蓋、標準化(hua)、公益性(xing)的公共信(xin)(xin)用(yong)(yong)(yong)綜合(he)評(ping)(ping)價(jia),定(ding)(ding)期將評(ping)(ping)價(jia)結果推(tui)送至(zhi)相(xiang)關政府部(bu)門、金融機構、行業協(xie)(xie)會商會參(can)考(kao)使用(yong)(yong)(yong),并依(yi)照有關規定(ding)(ding)向(xiang)社會公開(kai)。推(tui)動相(xiang)關部(bu)門利用(yong)(yong)(yong)公共信(xin)(xin)用(yong)(yong)(yong)綜合(he)評(ping)(ping)價(jia)結果,結合(he)部(bu)門行業管理(li)數(shu)據(ju),建立行業信(xin)(xin)用(yong)(yong)(yong)評(ping)(ping)價(jia)模(mo)型,為信(xin)(xin)用(yong)(yong)(yong)監(jian)管提供(gong)更精準的依(yi)據(ju)。(發(fa)展(zhan)改革委牽頭(tou),各部(bu)門按職責分(fen)別(bie)負(fu)責)

     (七)大力推進信(xin)(xin)(xin)用(yong)分(fen)(fen)級(ji)分(fen)(fen)類(lei)監管(guan)。在充分(fen)(fen)掌握信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息、綜合(he)(he)研判信(xin)(xin)(xin)用(yong)狀況的(de)基(ji)礎上,以公共信(xin)(xin)(xin)用(yong)綜合(he)(he)評價(jia)(jia)結(jie)(jie)果(guo)、行(xing)業信(xin)(xin)(xin)用(yong)評價(jia)(jia)結(jie)(jie)果(guo)等為依據(ju),對(dui)監管(guan)對(dui)象進行(xing)分(fen)(fen)級(ji)分(fen)(fen)類(lei),根(gen)據(ju)信(xin)(xin)(xin)用(yong)等級(ji)高低采(cai)取(qu)差異化的(de)監管(guan)措施。“雙隨機、一(yi)公開(kai)”監管(guan)要與信(xin)(xin)(xin)用(yong)等級(ji)相結(jie)(jie)合(he)(he),對(dui)信(xin)(xin)(xin)用(yong)較好、風(feng)險較低的(de)市(shi)場(chang)主體(ti),可合(he)(he)理降(jiang)低抽(chou)查比例(li)和頻(pin)次,減少對(dui)正常(chang)生產經營(ying)的(de)影(ying)響(xiang);對(dui)信(xin)(xin)(xin)用(yong)風(feng)險一(yi)般的(de)市(shi)場(chang)主體(ti),按(an)常(chang)規比例(li)和頻(pin)次抽(chou)查;對(dui)違法(fa)失信(xin)(xin)(xin)、風(feng)險較高的(de)市(shi)場(chang)主體(ti),適當提高抽(chou)查比例(li)和頻(pin)次,依法(fa)依規實行(xing)嚴(yan)管(guan)和懲(cheng)戒。(各地區各部(bu)門按(an)職責(ze)(ze)分(fen)(fen)別負責(ze)(ze))

       四(si)、完善(shan)事后環(huan)節信用監管

     (八)健(jian)全失(shi)(shi)(shi)信(xin)(xin)聯(lian)(lian)(lian)合(he)(he)懲戒對(dui)(dui)象認(ren)(ren)定(ding)機制(zhi)(zhi)。有關(guan)部門(men)依據(ju)在事前(qian)、事中監(jian)管(guan)(guan)環節(jie)獲取并認(ren)(ren)定(ding)的(de)(de)失(shi)(shi)(shi)信(xin)(xin)記錄,依法依規建立健(jian)全失(shi)(shi)(shi)信(xin)(xin)聯(lian)(lian)(lian)合(he)(he)懲戒對(dui)(dui)象名(ming)單(dan)制(zhi)(zhi)度(du)(du)。以(yi)相(xiang)關(guan)司法裁判(pan)、行(xing)政處罰、行(xing)政強制(zhi)(zhi)等處理結果為(wei)(wei)依據(ju),按程(cheng)(cheng)序將涉及性質惡劣、情節(jie)嚴(yan)重、社(she)會(hui)危(wei)害較大的(de)(de)違法失(shi)(shi)(shi)信(xin)(xin)行(xing)為(wei)(wei)的(de)(de)市(shi)場主體納入失(shi)(shi)(shi)信(xin)(xin)聯(lian)(lian)(lian)合(he)(he)懲戒對(dui)(dui)象名(ming)單(dan)。加(jia)快完善相(xiang)關(guan)管(guan)(guan)理辦法,明(ming)確認(ren)(ren)定(ding)依據(ju)、標準(zhun)、程(cheng)(cheng)序、異議(yi)申訴(su)和(he)退出(chu)機制(zhi)(zhi)。制(zhi)(zhi)定(ding)管(guan)(guan)理辦法要(yao)充分(fen)征求社(she)會(hui)公(gong)眾意見,出(chu)臺的(de)(de)標準(zhun)及其(qi)具(ju)體認(ren)(ren)定(ding)程(cheng)(cheng)序以(yi)適當方式向社(she)會(hui)公(gong)開。支(zhi)持有關(guan)部門(men)根據(ju)監(jian)管(guan)(guan)需(xu)要(yao)建立重點(dian)關(guan)注對(dui)(dui)象名(ming)單(dan)制(zhi)(zhi)度(du)(du),對(dui)(dui)存(cun)在失(shi)(shi)(shi)信(xin)(xin)行(xing)為(wei)(wei)但嚴(yan)重程(cheng)(cheng)度(du)(du)尚未達到失(shi)(shi)(shi)信(xin)(xin)聯(lian)(lian)(lian)合(he)(he)懲戒對(dui)(dui)象認(ren)(ren)定(ding)標準(zhun)的(de)(de)市(shi)場主體,可實施(shi)與其(qi)失(shi)(shi)(shi)信(xin)(xin)程(cheng)(cheng)度(du)(du)相(xiang)對(dui)(dui)應的(de)(de)嚴(yan)格監(jian)管(guan)(guan)措(cuo)施(shi)。(各(ge)部門(men)按職責(ze)分(fen)別負責(ze))

     (九)督(du)促失(shi)信(xin)(xin)(xin)市(shi)場(chang)主(zhu)體(ti)(ti)限(xian)期整(zheng)(zheng)(zheng)改。失(shi)信(xin)(xin)(xin)市(shi)場(chang)主(zhu)體(ti)(ti)應當(dang)在規定(ding)期限(xian)內認(ren)真整(zheng)(zheng)(zheng)改,整(zheng)(zheng)(zheng)改不到(dao)位的(de),按(an)照“誰認(ren)定(ding)、誰約談(tan)”的(de)原(yuan)則,由認(ren)定(ding)部(bu)門依(yi)法依(yi)規啟動提示約談(tan)或警示約談(tan)程序,督(du)促失(shi)信(xin)(xin)(xin)市(shi)場(chang)主(zhu)體(ti)(ti)履行相(xiang)關(guan)義務、消除不良影響。約談(tan)記(ji)錄記(ji)入(ru)失(shi)信(xin)(xin)(xin)市(shi)場(chang)主(zhu)體(ti)(ti)信(xin)(xin)(xin)用記(ji)錄,統一歸(gui)集后(hou)納入(ru)全(quan)國(guo)信(xin)(xin)(xin)用信(xin)(xin)(xin)息共享平臺。大力(li)推進(jin)重(zhong)點領域失(shi)信(xin)(xin)(xin)問題專項治理,采取(qu)有力(li)有效措施加快(kuai)推進(jin)整(zheng)(zheng)(zheng)改。(各部(bu)門按(an)職責(ze)分別負責(ze))

     (十)深入(ru)開(kai)展失(shi)(shi)信(xin)(xin)(xin)(xin)聯(lian)合懲(cheng)(cheng)(cheng)戒(jie)。加快構建(jian)跨地(di)(di)區、跨行(xing)業、跨領(ling)域的(de)失(shi)(shi)信(xin)(xin)(xin)(xin)聯(lian)合懲(cheng)(cheng)(cheng)戒(jie)機制,從根本上解決(jue)失(shi)(shi)信(xin)(xin)(xin)(xin)行(xing)為反復(fu)出現、易地(di)(di)出現的(de)問題。依法依規建(jian)立聯(lian)合懲(cheng)(cheng)(cheng)戒(jie)措施(shi)(shi)(shi)清單(dan),動態更(geng)新并向社會(hui)公(gong)(gong)開(kai),形成行(xing)政性(xing)、市場(chang)性(xing)和行(xing)業性(xing)等懲(cheng)(cheng)(cheng)戒(jie)措施(shi)(shi)(shi)多管(guan)(guan)齊下(xia),社會(hui)力量(liang)廣泛參與的(de)失(shi)(shi)信(xin)(xin)(xin)(xin)聯(lian)合懲(cheng)(cheng)(cheng)戒(jie)大格局。重(zhong)點實(shi)施(shi)(shi)(shi)懲(cheng)(cheng)(cheng)戒(jie)力度大、監(jian)管(guan)(guan)效果好(hao)的(de)失(shi)(shi)信(xin)(xin)(xin)(xin)懲(cheng)(cheng)(cheng)戒(jie)措施(shi)(shi)(shi),包括依法依規限(xian)制失(shi)(shi)信(xin)(xin)(xin)(xin)聯(lian)合懲(cheng)(cheng)(cheng)戒(jie)對(dui)象股票發行(xing)、招標投標、申請財政性(xing)資金項目、享受稅(shui)收(shou)優惠等行(xing)政性(xing)懲(cheng)(cheng)(cheng)戒(jie)措施(shi)(shi)(shi),限(xian)制獲(huo)得授信(xin)(xin)(xin)(xin)、乘(cheng)(cheng)坐飛機、乘(cheng)(cheng)坐高等級列車和席次(ci)等市場(chang)性(xing)懲(cheng)(cheng)(cheng)戒(jie)措施(shi)(shi)(shi),以及通報批評、公(gong)(gong)開(kai)譴責(ze)等行(xing)業性(xing)懲(cheng)(cheng)(cheng)戒(jie)措施(shi)(shi)(shi)。(發展改革委牽頭(tou),各地(di)(di)區各部門按(an)職責(ze)分別負(fu)責(ze))

     (十(shi)一(yi))堅決依法依規實(shi)施(shi)(shi)(shi)市(shi)場(chang)和(he)行業(ye)禁入措施(shi)(shi)(shi)。以(yi)食品藥品、生態環境(jing)、工(gong)程質量、安全(quan)(quan)生產、養老托幼、城市(shi)運行安全(quan)(quan)等(deng)與人(ren)民群眾生命(ming)財(cai)產安全(quan)(quan)直(zhi)接(jie)相關的(de)領域為重點,實(shi)施(shi)(shi)(shi)嚴(yan)格監管(guan),加大懲戒力(li)度。對拒不(bu)履行司法裁判或行政(zheng)處(chu)罰決定、屢犯不(bu)改、造成重大損失(shi)的(de)市(shi)場(chang)主體及其相關責任人(ren),堅決依法依規在(zai)一(yi)定期限內(nei)實(shi)施(shi)(shi)(shi)市(shi)場(chang)和(he)行業(ye)禁入措施(shi)(shi)(shi),直(zhi)至永遠(yuan)逐出(chu)市(shi)場(chang)。(發展(zhan)改革(ge)委(wei)牽(qian)頭,各(ge)地區各(ge)部門按職責分別(bie)負責)

     (十二)依法追究違(wei)法失(shi)信(xin)責(ze)(ze)任(ren)。建立健全責(ze)(ze)任(ren)追究機制(zhi),對(dui)被列入失(shi)信(xin)聯合懲戒對(dui)象名單的(de)市場主體,依法依規對(dui)其法定代表人(ren)(ren)或主要負(fu)(fu)責(ze)(ze)人(ren)(ren)、實(shi)際(ji)控制(zhi)人(ren)(ren)進行(xing)(xing)失(shi)信(xin)懲戒,并將相關失(shi)信(xin)行(xing)(xing)為記入其個人(ren)(ren)信(xin)用記錄。機關事(shi)業(ye)單位(wei)、國有企業(ye)出現違(wei)法失(shi)信(xin)行(xing)(xing)為的(de),要通報上級主管(guan)單位(wei)和審計部(bu)門(men);工作人(ren)(ren)員(yuan)出現違(wei)法失(shi)信(xin)行(xing)(xing)為的(de),要通報所在單位(wei)及相關紀檢監(jian)察、組織人(ren)(ren)事(shi)部(bu)門(men)。(各地區各部(bu)門(men)按職責(ze)(ze)分(fen)別(bie)負(fu)(fu)責(ze)(ze))

     (十三)探(tan)索建立信(xin)(xin)用修(xiu)(xiu)復機制(zhi)。失(shi)信(xin)(xin)市(shi)場(chang)主體在規(gui)定(ding)期限內糾正失(shi)信(xin)(xin)行為(wei)、消除不良(liang)影(ying)響的(de),可通過作(zuo)出(chu)信(xin)(xin)用承諾、完(wan)成(cheng)信(xin)(xin)用整改、通過信(xin)(xin)用核(he)查、接受專題培訓、提(ti)交信(xin)(xin)用報告、參(can)加(jia)公益慈善活動等(deng)方式(shi)開(kai)展信(xin)(xin)用修(xiu)(xiu)復。修(xiu)(xiu)復完(wan)成(cheng)后,各(ge)地區(qu)各(ge)部(bu)門要按程序及(ji)時停(ting)止公示其失(shi)信(xin)(xin)記錄,終止實施聯合懲戒措(cuo)施。加(jia)快建立完(wan)善協同聯動、一(yi)網通辦機制(zhi),為(wei)失(shi)信(xin)(xin)市(shi)場(chang)主體提(ti)供高(gao)效(xiao)便(bian)捷的(de)信(xin)(xin)用修(xiu)(xiu)復服務(wu)(wu)(wu)。鼓勵(li)符合條件的(de)第(di)三方信(xin)(xin)用服務(wu)(wu)(wu)機構(gou)向失(shi)信(xin)(xin)市(shi)場(chang)主體提(ti)供信(xin)(xin)用報告、信(xin)(xin)用管理(li)咨詢等(deng)服務(wu)(wu)(wu)。(發展改革委牽頭,各(ge)地區(qu)各(ge)部(bu)門按職(zhi)責(ze)分(fen)別負責(ze))

       五、強化(hua)信用監(jian)管的支撐保障

     (十五(wu))大力推進(jin)信用監管信息(xi)(xi)公(gong)(gong)開(kai)公(gong)(gong)示(shi)。在(zai)(zai)行(xing)政(zheng)(zheng)許可、行(xing)政(zheng)(zheng)處罰信息(xi)(xi)集中(zhong)公(gong)(gong)示(shi)基(ji)礎(chu)上,依(yi)托“信用中(zhong)國(guo)”網(wang)站、中(zhong)國(guo)政(zheng)(zheng)府網(wang)或其他渠道(dao),進(jin)一步研(yan)究(jiu)推動(dong)行(xing)政(zheng)(zheng)強制、行(xing)政(zheng)(zheng)確認、行(xing)政(zheng)(zheng)征收、行(xing)政(zheng)(zheng)給付、行(xing)政(zheng)(zheng)裁決、行(xing)政(zheng)(zheng)補償、行(xing)政(zheng)(zheng)獎勵和行(xing)政(zheng)(zheng)監督檢查(cha)等其他行(xing)政(zheng)(zheng)行(xing)為信息(xi)(xi)7個工作日內上網(wang)公(gong)(gong)開(kai),推動(dong)在(zai)(zai)司法裁判(pan)和執行(xing)活動(dong)中(zhong)應當(dang)公(gong)(gong)開(kai)的失信被(bei)執行(xing)人、虛假訴(su)訟失信人相關信息(xi)(xi)通(tong)過適(shi)當(dang)渠道(dao)公(gong)(gong)開(kai),做到“應公(gong)(gong)開(kai)、盡公(gong)(gong)開(kai)”。(各地區各部(bu)門按職責分別負(fu)責)

     (十六(liu))充(chong)(chong)分(fen)(fen)(fen)發(fa)揮“互(hu)聯(lian)(lian)網(wang)(wang)+”、大(da)數據(ju)對信(xin)用(yong)(yong)監(jian)(jian)(jian)管的支(zhi)撐作(zuo)用(yong)(yong)。依托國(guo)家(jia)“互(hu)聯(lian)(lian)網(wang)(wang)+監(jian)(jian)(jian)管”等系(xi)(xi)統,有(you)效整合公(gong)共信(xin)用(yong)(yong)信(xin)息(xi)(xi)(xi)、市(shi)場(chang)信(xin)用(yong)(yong)信(xin)息(xi)(xi)(xi)、投訴舉報信(xin)息(xi)(xi)(xi)和(he)互(hu)聯(lian)(lian)網(wang)(wang)及第三方相關(guan)信(xin)息(xi)(xi)(xi),充(chong)(chong)分(fen)(fen)(fen)運用(yong)(yong)大(da)數據(ju)、人(ren)工智能等新一(yi)(yi)代信(xin)息(xi)(xi)(xi)技(ji)術,實現(xian)(xian)信(xin)用(yong)(yong)監(jian)(jian)(jian)管數據(ju)可(ke)比對、過程可(ke)追(zhui)溯、問(wen)題(ti)(ti)可(ke)監(jian)(jian)(jian)測。鼓勵各(ge)地區各(ge)部門結合實際(ji),依法(fa)依規(gui)(gui)(gui)與大(da)數據(ju)機(ji)構合作(zuo)開(kai)發(fa)信(xin)用(yong)(yong)信(xin)息(xi)(xi)(xi),及時(shi)動(dong)態(tai)掌握市(shi)場(chang)主體經營情況(kuang)及其規(gui)(gui)(gui)律特征。充(chong)(chong)分(fen)(fen)(fen)利(li)用(yong)(yong)國(guo)家(jia)“互(hu)聯(lian)(lian)網(wang)(wang)+監(jian)(jian)(jian)管”等系(xi)(xi)統建立風(feng)(feng)險(xian)預(yu)判預(yu)警機(ji)制(zhi),及早(zao)發(fa)現(xian)(xian)防范苗頭(tou)性和(he)跨行(xing)業跨區域(yu)風(feng)(feng)險(xian)。運用(yong)(yong)大(da)數據(ju)主動(dong)發(fa)現(xian)(xian)和(he)識別(bie)違(wei)法(fa)違(wei)規(gui)(gui)(gui)線索,有(you)效防范危害公(gong)共利(li)益(yi)和(he)群眾(zhong)生命財產安全的違(wei)法(fa)違(wei)規(gui)(gui)(gui)行(xing)為。鼓勵通過物(wu)聯(lian)(lian)網(wang)(wang)、視聯(lian)(lian)網(wang)(wang)等非(fei)接觸式監(jian)(jian)(jian)管方式提(ti)升執法(fa)監(jian)(jian)(jian)管效率,實現(xian)(xian)監(jian)(jian)(jian)管規(gui)(gui)(gui)范化、精準化、智能化,減(jian)少(shao)人(ren)為因素,實現(xian)(xian)公(gong)正監(jian)(jian)(jian)管,杜絕隨意(yi)檢(jian)查(cha)、多頭(tou)監(jian)(jian)(jian)管等問(wen)題(ti)(ti),實現(xian)(xian)“進一(yi)(yi)次門、查(cha)多項事(shi)”,減(jian)少(shao)對監(jian)(jian)(jian)管對象的擾動(dong)。(國(guo)務院辦公(gong)廳、發(fa)展改革委、市(shi)場(chang)監(jian)(jian)(jian)管總(zong)局牽頭(tou),各(ge)部門按職責分(fen)(fen)(fen)別(bie)負(fu)責)

     (十七(qi))切(qie)實(shi)(shi)加大信(xin)(xin)用信(xin)(xin)息(xi)安(an)全(quan)和市(shi)場(chang)主體權(quan)(quan)益保(bao)護(hu)力度。嚴肅(su)查(cha)處違規泄露、篡改信(xin)(xin)用信(xin)(xin)息(xi)或利用信(xin)(xin)用信(xin)(xin)息(xi)謀(mou)私等行為。加強信(xin)(xin)用信(xin)(xin)息(xi)安(an)全(quan)基(ji)礎設施和安(an)全(quan)防護(hu)能力建設。建立健全(quan)信(xin)(xin)用信(xin)(xin)息(xi)異議投訴制度,對市(shi)場(chang)主體提出(chu)異議的(de)信(xin)(xin)息(xi),信(xin)(xin)息(xi)提供和采(cai)集單(dan)(dan)位要盡快核實(shi)(shi)并(bing)反饋結果(guo),經核實(shi)(shi)有誤(wu)的(de)信(xin)(xin)息(xi)要及時予以更正(zheng)或撤銷。因錯誤(wu)認定失信(xin)(xin)聯合懲(cheng)(cheng)戒對象名單(dan)(dan)、錯誤(wu)采(cai)取失信(xin)(xin)聯合懲(cheng)(cheng)戒措(cuo)施損害市(shi)場(chang)主體合法(fa)權(quan)(quan)益的(de),有關(guan)部門和單(dan)(dan)位要積極(ji)采(cai)取措(cuo)施消(xiao)除(chu)不良影(ying)響(xiang)。(各(ge)地(di)區各(ge)部門按(an)職責分別負(fu)責)

       六(liu)、加(jia)強信用監管的組織(zhi)實施

     (十九)加(jia)強(qiang)組織領導。各(ge)地(di)區各(ge)部(bu)(bu)門(men)要(yao)把構建以(yi)信(xin)用(yong)為(wei)基礎(chu)的新型監(jian)管(guan)(guan)(guan)機制(zhi)作(zuo)為(wei)深入(ru)推進“放管(guan)(guan)(guan)服”改(gai)革(ge)的重要(yao)舉(ju)措,擺在更加(jia)突出的位置(zhi),加(jia)強(qiang)組織領導,細(xi)化責(ze)任分工,有力(li)有序有效(xiao)推動落(luo)實(shi)。完善信(xin)用(yong)監(jian)管(guan)(guan)(guan)的配套制(zhi)度,并加(jia)強(qiang)與其(qi)他“放管(guan)(guan)(guan)服”改(gai)革(ge)事項的銜接。負有市場監(jian)管(guan)(guan)(guan)、行業(ye)監(jian)管(guan)(guan)(guan)職(zhi)責(ze)的部(bu)(bu)門(men)要(yao)切實(shi)承擔行業(ye)信(xin)用(yong)建設和信(xin)用(yong)監(jian)管(guan)(guan)(guan)的主體責(ze)任,充分發(fa)揮行業(ye)組織、第三(san)方信(xin)用(yong)服務機構作(zuo)用(yong),為(wei)公(gong)眾監(jian)督(du)創(chuang)造(zao)有利條件(jian),整合(he)形成全(quan)社會共同參與信(xin)用(yong)監(jian)管(guan)(guan)(guan)的強(qiang)大合(he)力(li)。(發(fa)展改(gai)革(ge)委牽頭,各(ge)地(di)區各(ge)部(bu)(bu)門(men)按(an)職(zhi)責(ze)分別負責(ze))

     (二十一(yi)(yi))加快建(jian)章(zhang)立制。推動制定社會信(xin)(xin)用(yong)(yong)體系(xi)建(jian)設相關法律,加快研究出臺公共(gong)信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)管(guan)理條例、統一(yi)(yi)社會信(xin)(xin)用(yong)(yong)代碼(ma)管(guan)理辦法等法規(gui)(gui)。建(jian)立健(jian)全全國統一(yi)(yi)的(de)信(xin)(xin)用(yong)(yong)監管(guan)規(gui)(gui)則和標準,及時出臺相關地方性(xing)法規(gui)(gui)、政府規(gui)(gui)章(zhang)或規(gui)(gui)范性(xing)文(wen)件,將信(xin)(xin)用(yong)(yong)監管(guan)中行之有效(xiao)的(de)做法上升為制度規(gui)(gui)范。抓(zhua)緊制定開展(zhan)信(xin)(xin)用(yong)(yong)監管(guan)急需的(de)國家(jia)標準。(發展(zhan)改革委(wei)、司法部(bu)(bu)牽(qian)頭,各(ge)地區各(ge)部(bu)(bu)門按(an)職責分(fen)別負(fu)責)
